A student in New York frequently ran away from school which was very close to the Long Island Expressway. In addition, the student chased other students, hit teachers and students with crumpled paper, and chewed on sharp objects while leaning back in his chair. The school believed that the student posed a danger to himself and others. The school placed the student on homebound services pending a psychiatric evaluation and a review of the case conference committee. The parent objected, invoking the stay-put provision. The school asked for and received a preliminary injunction barring the student from school. The preliminary injunction ended prior to and evaluation and review by the case conference committee. The school asked for a permanent injunction.
