Scenario 7

A fifteen year old student with a specific learning disability (SLD) had in previous weeks been beaten by a gang of youths outside an apartment building. Subsequently, the student brought a gun to school and was arrested for the offence. The student had not had any other disciplinary actions at school. The court ordered the student to house arrest. The school provided educational services at his home. The CCC met, reviewed the student’s IEP and all relevant data. Based on that review, the CCC determined that the behavior was not a manifestation of the student’s SLD. The parent objected to the finding and requested a due process hearing.

Was the manifestation determination made in accordance with Article 7 and IDEA 07 regulations? Explain.
