Bart is a nine year old 3rd grade student. Bart has not made the educational progress expected of students of his age and grade. Interventions that were designed for Bart did not increased achievement as expected. An educational evaluation was conducted and the case conference committee determined that Bart is a student with a mild cognitive disability. An IEP was developed for Bart based on his present level of performance and the progress the case conference committee expects Bart will make in the next year.

1. Should Ned's parents be given written notice before the initial IEP is implemented? Explain.
2. Must Ned's parents provide written consent before the IEP is implemented? Explain.
