MODULE DESCRIPTION:

In this module procedures for the disciplining of students identified with a disability will be discussed. The user will obtain an understanding of procedures to be utilized in the removal or disciplinary change of placement for a student with a disability. These requirements will be followed up by an overview of procedures for making a manifestation determination as well as for placing a student in an interim alternative educational setting (IAES). In addition, the protections afforded a student who has not yet been determined eligible for special education and related services are discussed. Finally, procedures for referring a student with a disability to law enforcement officials will be outlined.

INSTRUCTIONAL PROFICIENCIES:

Standard #1: FOUNDATIONS
Educators of students with exceptional needs understand the field of special education as an evolving and changing discipline based on philosophies, evidence-based principles and theories, relevant laws and policies, diverse and historical points of view, and human issues.

Performances:
3. conducts educational and other professional activities in compliance with federal, state and district laws, policies and procedures.
5. accesses professional resources to remain current on state and federal regulations and evidence-based practices regarding special education services and procedures.

Knowledge:
3. understands state and federal regulations, local level policies and procedures, and due process requirements as they relate to assessment, eligibility, and placement of students with exceptional needs.

4. knows the rights and responsibilities of parents, students, educators, and other professionals as they relate to students with exceptional needs.

5. understands the concepts of free, appropriate, public education (FAPE) and least restrictive environment (LRE).

Standard #9: PROFESSIONAL AND ETHICAL PRACTICE
The educator of students with exceptional needs understands reflective and ethical practices and the importance of ongoing professional development to promote student growth.

Performances:
4. conducts professional activities in compliance with applicable laws and policies.

INSTRUCTIONAL EVENTS:

  1. Study the narrative section of module. Visit web sites within the narrative section.
  2. Read frequently asked questions regarding discipline
  3. Read the accounts of actual administrative or judicial cases regarding the discipline of students with disabilities. Answer questions regarding the cases. See if your answers match the hearing officer or judges ruling.
  4. Write a two-page reflection paper on the equity of discipline for students with disabilities as compared to general education students.
