This module is intended to outline the federal and state requirements, under IDEA 04 and Indiana’s Article 7, regarding the Notice of Procedural Safeguards. Users will gain an understanding of the purpose of the Notice of Procedural Safeguards. This module will guide users through requirements of the content Notice of Procedural Safeguards as well as when the Notice of Procedural Safeguards must be provided to parents of students with disabilities or to students with disabilities eighteen years old or older.
Upon completion of this module the user will be able to:
- Explain the purpose of the Notice of Procedural Safeguards and Prior Notice provisions in federal (IDEA 04) and state (Article 7) regulations.
- Provide parents or eligible students with a full explanation of their rights with regard to the provision of a Free Appropriate Public Education (FAPE).
- Adapt a sample Notice of Procedural Safeguards to meet local education agency needs.
Standard #1: FOUNDATIONS
Educators of students with exceptional needs understand the field of special education as an evolving and changing discipline based on philosophies, evidence-based principles and theories, relevant laws and policies, diverse and historical points of view, and human issues.

Knowledge 5: Understands the concepts of free, appropriate, public education (FAPE) and least restrictive environment (LRE).

The educator of students with exceptional needs understands reflective and ethical practices and the importance of ongoing professional development to promote student growth.
Performance 4: Conducts professional activities in compliance with applicable laws and policies.
Standard #10: COLLABORATION
The educator of students with exceptional needs collaborates with families, colleagues, related service providers, and community members in culturally responsive ways to support students’ learning.
Performance 2: Communicates effectively in verbal, nonverbal, and written modes.
